How Do I Make a Living Trust?

To create a living trust, the following actions must be taken:

  1. A trust document must be drafted, naming trustee(s) and beneficiaries.
  2. The document must be signed and notarized.
  3. Property is to be transferred to the trustee.

If you name yourself as the primary trustee, it is important that you name a successor to take over in the event of your death. Along with a living trust, establishing a will is highly important. This provides a backup of sorts for any property that doesn’t make it into your trust, such as newly acquired property after the drafting of your living trust document. You can name someone in your will to inherit any property that is outside the bounds of your living trust.
